Solved Violation of ToS??

Post by Doomchild on March 26th 2012, 1:07 pm

Hi,
I have a red notification box in my admin panel stating this

Dear "www.aboardwithnoname.com" forum administrator(s), it appears that your forum doesn't respect our Terms of service. Our service is free, so we are urged to only display legal content on the forums.

You have have until the 31-03-2012 to be in conformity. After this delay, we will have to delete your forum if it still isn't in conformity.

Now I've only coincidentally found out about this, because I rarely need the admin panel. Got no notification via e-mail, pm or what have you. And it doesn't even state what this is about exactly. So if I hadn't checked the admin panel (again coincidentally) by April, the whole forum would have been gone? Confused
That seems awfully arbitrary.

But to the point: What exactly is this about?

Regards,
D.

Solved Re: Violation of ToS??

Post by Doomchild on March 26th 2012, 7:31 pm

But the stuff in there is all legit.
Those are links to bootlegs of live performances of Dax Riggs' bands. He heavily endorses the sharing of such materials. All released studio recordings are off limits, and there are two or three song demos he doesn't want to surface there. Needless to say we honor his wishes.

Apart from that there are few links to live recordings, which can also be found on http://archive.org/details/etree. Those are legit too. And most of them are posted by the people who avtually made the recordings. More often than not, the source is the soundboard. So I find that indicative at least of the venue owners and bands being okay with the recording of the shows.

Does anyone of you two have any say in this? If not, who can i get in contact with about this?
Thanks in advance.

There is nothing the like on our board.

And to be able to correct anything that slipped past me, I would need someone to specify the issue in question, please.

Hi,

There is unfortunately no-one able to tell you the specific reason as to why you've received this warning.

Sorry. TT

So, obviously, if I do nothing, the forum will be deleted in 4 days.
That's messed up. Who issued the warning then?

Unfortunately yes.

The warning was given by a member of ForuMotion's Litigation Team, whom specifically, I don't know.
ForuMotion also has a policy to not give any reason(s) to why the forum is being removed. Sorry.

Hello Smile

I've seen that there are megaupload links in your forum, which is copyright infringments.

I didn't seen all the forum, but that's at least one thing you should check.

Hi, thanks for the pointers.
According to this logic however Filedropper (apparently a Forumotion affiliate) "is copyright infringement" too.
But I'll happily delete those links, since they don't work anymore anyway. If this was the reason for the threat of deletion, it seems a bit short-sighted to me. But who am I to judge, eh? Confused

It's a copyright infringment when you don't have the legal authorization from an author to post his works, yes.
Your links don't work anymore because megaupload was sentenced, as you should know.

As I wrote earlier, the particular artist our board is about encourages the sharing of his music.

I'm not here to debate and I'm not the one who takes the decision.

I was just trying to help you and make a clarification on what's illegal.

As we answered to your issue, we can considered it as solved Wink

Thank you !
