Solved Copyright complaint help

Post by carapeach June 12th 2012, 5:01 pm

Hello. Two of my copyrighted images were uploaded by someone to servimg.com - however I only know the direct URL to these JPG images. I cannot see what forum these were posted on. I tried to enter the information on the litigation form to complain about a forum, but it will not accept the direct URL to servimg.com Who do I complain to for my images on servimg.com? I know there is a "report as adult content" button, but I'm complaining about copyright, not porn. What a Face I've searched these help posts and can't seem to find my answer. Thank you for any assistance.

Solved Re: Copyright complaint help

Post by carapeach June 12th 2012, 5:19 pm

Hello - yes I have been to that link. The problem is I do not know the name of the forum that has taken my images. I only know the direct URL to the imgserv.com/xyz.jpg address. The link below for filing a complaint does not work for the direct JPG addresses from Imgserv. For example, this is one of my images: https://servimg.com/view/11641084/1780 There are other copyrighted images of mine from that same user (11641084) that I would like to get removed from the servimg server.

Is there another link I can use to report?

Thanks, Cara

Do you have a copyright on the images like a watermark ?
Also was it clear that your pic's was copyrighted ?
Was your pic's out for the public to see ?

Why i ask this is if you have not got a copy right on the pic's at all then you can not clam the copy rights also if you post a pic in Public you wave the right without a copyright watermark

The copyrights are not really anything to do with FM as it was servimg.com that the images come from

As far as i can see there is no copyright Report button or link so best thing to do is use there other link and just tell them your problem and they should send this info on to the right members of there staff

Sorry i could not help anymore than this as this has nothing really to do with FM

Solved Re: Copyright complaint help

Sure hope I'm doing this correctly.

First image on servimg.com that belongs to my client's company (I'm a legal secretary and not very technical so please bear with me):

Second image on servimg.com that belongs to her company:

First proof of copyright is here (we had to watermark images about a year ago due to constant infringement):

Second proof of copyright

The main address has legal/copyright information:

While these images might not look like much to you I love you people are posting the ones with the watermark cut off and using them to sell products, cutting into her business. Shit

Thanks

Well this will have to be passed on to a pro-admin
I am sure they have a way to see where are images are posted from servimg.
Servimg is forumotioms image host.

you can clearly see the web addresses was on the images first. they appear to be stretched and cut off. It's obvious the intention was to remove the web address from the images.

The only question i have is.
If you do not know where these images where posted, how did you obtain the links from servimg?

Other then that i have marked it for a pro admin to investigate.

The company who owns these images is based in the USA. Material becomes copyrighted upon the minute of creation according to the USA Copyright office.

See Item #5 here: http://www.copyright.gov/help/faq/faq-general.html

"Do I have to register with your office to be protected?
No. In general, registration is voluntary. Copyright exists from the moment the work is created. You will have to register, however, if you wish to bring a lawsuit for infringement of a U.S. work. See Circular 1, Copyright Basics, section “Copyright Registration.”

As an image hosting server, considering where you are based, you are required by Law to comply with DMCA protocol http://en.wikipedia.org/wiki/Digital_Millennium_Copyright_Act otherwise you can be held liable for copyright infringement, especially now that you have received a complaint of infringement.

She saw her images posted on several websites as "items for sale" (they are knock-offs) - and looking at the URL of every one of the images, they linked back to only your server.

Please let me know what I can do to expedite this matter. Thank you.

Thank you very much to both of you. For what it's worth, she gave me one more image to give to you. This one shows the raw (but heavily watermarked to avoid more infringment) of the original raw camera shot, before cropping, before photoshopping, etc. This should give you a very clear idea of who owns this photo. Thanks.... posted below (with hide tags).
