Solved Does this violate ToS?

Post by Setrin October 6th 2012, 4:22 am

I created a forum as a supplement to a roleplaying MUSH some friends and I are planning on running. For those who don't know, a MUSH is a type of roleplaying environment that uses programmed rooms and objects to help simulate a setting that characters can interact with. It runs on an entirely independent program. Both the provider of the forum (here) and my MUSH provider have different, but not outright conflicting ToS that each must be adhered to. The two parts of this project are exclusive from one another in terms of operation and won't actually be linked, however the rules of the MUSH will be posted on the forum for ease of access and reading, as well as a place to put connection information.

The ToS difference comes in the fact that, while the forum does not allow for specific content standards to be breached, the MUSH has no such distinction and allows us to create rules to regulate, but allow various kinds of RP content on different portions of the grid. (We figured it'd be easier to contain than ban on a program where you can't actively watch everything.) These rules are among those posted on the forum, but do not actually pertain to the forum itself, which has its own set of rules perfectly in line with Forumotion's ToS, including a ban on sharing or talking about any scenes on the forum that violate the ToS there.

My previous forum provider required me to take down those rules, stating that, it didn't matter if the rules were for something other than the forum, it still violated their ToS on the grounds that it still talked about allowing roleplaying beyond a PG-13 scope regardless of whether they applied to a structurally unrelated venue.

My question is: Will the same rule apply here? here are the rules to my actual forum and here are the rules to the accompanying MUSH. Does this violate the ToS of the forum even if the content will not appear on it, but rather in a venue outside of the forum ToS? Is simply DISPLAYING the rules enough for a violation?

It does not matter what rules you have on your forum.

Do you disrespect any of the mentioned things in the TOS of forumotion?

As far as I know, I made a clear distinction between the differing sets of ToS and that the ToS of either the MUSH or forumotion are not to be broken in their respective applications. The rules of the forum itself is dictated by forumotion's ToS and the MUSH's rules by its ToS as set by my client provider. Even if the content of the MUSH can be a bit expanded, nothing that goes beyond forumotion's ToS can be posted on the forum. The only thing I have is what the rule discrepancies between the two are.

Basically it boils down to this: Despite it being for a separate venue, do I have to edit or remove any rules that aren't the same as the forum rules?

As far as I understand from what you are trying to ask, Well I don't believe Forumotion cares about another set of rules you created, as long as Forumotion TOS is respected.
