Solved Very specific questions regarding the ToS

Post by Guest Fri Mar 27 2015, 01:16

Good afternoon. I am known as Illy and the purpose of this message is to clarify certain points from the ToS so I can discern if this is an appropriate host to move my forum to, and what changes (since it is obvious it will need some, as you will see) would I need to undertake in order for it to be accepted.

My forum covers a wide range of practices encompassed in the term "sexual fetishes", so as such, please keep in mind that I will probably mention concepts that might cause acute rejection to some people, for the purposes of discerning what is allowed and what isn't. Please read on under your own responsibility. I realize it might be a question better asked via PM, but since it isn't allowed at first, and I wouldn't know who should I really address this question to, I think this is a better option, so it can reach more than one person of the staff.

As I intend to discern which is and isn't allowed, I'll mark everything with numbers for easier addressing, and will provide as accurate a description I can, complimented with examples of what was previously a normal behaviour in the forum, prior to our host's change of ToS.

1) The ToS count "pornography" as illicit content. As clear as it sounds, it still leaves a window open as to what is considered "pornography". I personally think it would only cover practices known as "hardcore" as well as other overly suggestive or depictive material, such as open or aroused genitals. Of course, I expect that definition to change from person to person, "subjective" as they say. I would appreciate to know what is forumotion's official stand on it.

2) The ToS also include a section where "vulgar or obscene" material is likewise rejected, also suffering of that "subjective" problem. I know the most explicit of fetishes would be ruled out by the issue addressed in 1), but there are still plenty of "safe" sexual fetishes that don't involve anything close to genitalia yet might be considered "obscene" by any close-minded individual. Examples such as feet worship, tail worship, giant/tiny fantasies, relationships with tauric, humanoid or otherwise fantastic creatures (excluding bestiality), devouring, or even scatology might give insight into the range of fetishes covered which might yet be subject of extradition should a complaint arise. I would also appreciate to know if this term is enforced in a general way or rather in a case-by-case basis.

I have also seen some questions regarding nudity asked sporadically in this forum, and while the general answer was the same, "no nudity allowed", there were also different, special indications involving not only pictures and books/stories, but speech or discussion as well. As such, I'd like to ask:

3) While nudity, I understand full nudity, isn't allowed, is it the same for partial nudity? This could address being topless, showing part of the breasts/the pubis but covering the intimate parts, exposing the rear, or showing other, less commonly sexualized areas such as the abdomen, armpits, legs or back, so I'd appreciate clarification on what level of detail might be acceptable.

4) Sexual fetishes, even if it wouldn't appear to at first sight, are an endless source of discussion. It is common for genitalia, breasts and other body parts to be mentioned and talked about anatomically, rather than sexually. Would this also result in a violation of the ToS? I know this might be pushing too hard into the line, but we have a trained eye to distinguish when the topic has indeed crossed it, as you could imagine, so it can be kept in check.

5) A special mention, since it is a fetish of its own yet can be taken both ways. Breast sucking, if not performed by an infant, is clearly considered a sexual act; however, breast milking for the purpose of extracting milk (regardless if that milk is later used sexually or not) would also be considered outside of the ToS?

tl;dr: Is forumotion open-minded about mild material, even if it is considered a sexual fetish? Is it gone over case-by-case or a single complaint might find a forum closed?

Thank you for taking the time of going over my post, it is sincerely appreciated. I look forward to reading your answer and working to polish the details.

Solved Re: Very specific questions regarding the ToS

Hello,

I believe Forumotion's stand is anything that can qualify as having to with nudity, pornography, Vulgar, etc is/can be considered 100% against the ToS. If someone reports it and it can be seen as such by any 1 person, I believe it can constuite as violation/ breach in agreement to their ToS. I do not know 100% specifics, but I can tell you forumotion stance is very broad and very strict, there is not really a specific level they have where it can be considered a breach, it could very mild and even written through text, it could still break the ToS.

For complete details you will need to read the TOS itself in the flesh: https://www.forumotion.com/terms-of-service

Solved Re: Very specific questions regarding the ToS

I believe I have cited parts of the ToS at 1) and 2), indicating that I have indeed read them. The ToS are very broad in regard to the sections that interest me, hence the in-depth questions that can't be answered by reading the ToS themselves, since they are up for interpretation.

Still, if your insight regarding forumotion's stance is true, I'm afraid there is little I can do to adapt. I will still wait for an official answer, if you don't mind, but thank you for the information.

Well that is up to you... but some officials have said this in this topic: https://help.forumotion.com/t139768-question-about-content-allowed-on-a-forum I was simply paraphrasing from them.

Hope it helps,

Anything related to sex or nudity is not allowed.  Your forum will break the Terms of Service.

Takes this as rule thumb:  could a 13 old read what is on your forum?
