Why is this theme allowed?

This is a question that I have to confirm with a global moderator or administrator of forumotion.

I have been on hitskin.com, and I have noticed a "want to be vBulletin theme".

Is this theme even allowed for us to use? Because, it has some of the default images from a vBulletin forum, .

And, I am using the images after I modified the theme of my forum to phpBB3 :

This theme has been around for awhile, but I just want to hear if it is safe for us to use on our forums from an administrator or a technician.

The english hitskin is not the only website with these themes, by the way,
