Solved Questions regarding the TOS

Post by Spyridon Tue 7 Sep 2010 - 18:09

Illicit Content Excerpt from TOS
"Forums that does welcome or promote warez, piracy, hacking, cracking,
spamming, attacks against networks or servers, pornography, racial
hatred, crimes against humanity, inappropriate activities on the
servers, or any other actions which violate any applicable laws, aren't
allowed. Any forum which contains texts, links, pictures, animations,
videos or any other content recognized as illegal will be deleted
without notice or warning. Forumotion.com reserves the right to delete
any accounts or forums considered like not conform to the rules quoted
here or specified in Forumotion.com or in the international website
rules according to the international internet law. Any illegal content
or act can or would be reported to the concerned services and
prosecuted."

Background
I created a fourm where fanfiction authors and readers could recommend stories to others as well as a place for posting challenges to others to write. Fanfiction by definition is a story that is written by fans of the show, book, manga, anime, etc and is not written for money but only for entertainment purposes.

Most of the fanfiction on the site is from the major fanfiction site FanFiction.Net which is up to date on who doesn't allow fanfiction, such as Anne Rice, author of 'The Vampire Chronicles' and the holder of Charlie Brown. FanFiction.Net also monitors the stories posted on that site, the stories range from K to M as defined by the Motion
Pictures Association of America. Due to a serious case a few years ago,
the site no longer accepts NC-17 rated stories and the more graphic
M-rated stories, though the milder M-Rated stories are allowed.

Situation
With that said, I do believe in monitoring the internet and as such, I try to keep on top of what is posted on my site. As with all written content, there are stories that are suitable only for really mature audiences and they do exist in the fanfiction world in a number of various forms. In response, I wanted to create a subsection where stories that are in such a category can be posted as up to this point, the more graphic stories weren't allowed.

I created a subsection with restricted access. To monitor who has access to the subsection, I created a group that I personally oversee (Vulgo Voluptas) that would be allowed to view/read/post in that subsection and where a member must provide a birth date to be added to the group where the minimum age is 18 regardless of what country you are in. If you are not in that group, you can't see it. I tested it oud before posting and found that one who wasn't in the group, the subsection was inaccessible.

But after posting the first thread in there, the forum started to act weird as every time I tried to view a thread in the other sections, they would redirect back to the forum main page. After a few minutes, I deleted the subsection through the forum admin panel, resulting in the forum going back to normal function.

Question
When it comes down to it, would posting the links to the more graphic stories be construed as breaking the TOS even after setting up a system where the access is monitored? One of the major rules of the forum is no posting of the actual stories as the space for the forum would be used up pretty quickly.

Another question is was the redirection of the thread links a glitch in the system or was it a warning that the content was not allowed and was a precursor to the forum being deleted?

Sorry for the long post but I don't wish for the forum to be deleted after moving here from another forum host because of ads. Link to the forum is in my profile.

Answers to your questions.

Yes they are breaking the TOS, even if you are setting up a system.

It must've been a temporary glitch.

So the only links that would be allowed would be the links from FanFiction.net since they too are strict on what they allow, right?

And in general, are the links to the fanfiction allowed, which is the main purpose of the site?

Well, if they allow links. Its upto them as long as the links you post don't take the user to a site which contains adult content. Basically as long as you respect the TOS.

All of the links from FF.Net and another forum, both of which make sure their stories are the milder forms of M-rated and below. They do have sister sites that carry that more mature stories but those as of yet haven't been posted on the site. Thanks for the clarification.
