I'm sorry to make another thread about this but it's important that I get a reply about this since my forum is at risk of being deleted.

I have this message in my admin panel:
"Dear "www.smokinelite.com" forum administrator(s), it appears that your forum doesn't respect our Terms of service. Our service is free, so we are urged to only display legal content on the forums.

You have have until the 13-06-2011 to be in conformity. After this delay, we will have to delete your forum if it still isn't in conformity."

Some people suggested it might be due to the footer links being taken away, so I put them back. However I have no way of knowing if that was the only problem and the timer is still there saying my forums will be deleted. What if there are other problems? Am I just meant to wait and hope my forums still exist in 3 days? I wish these messages came with specific reasons.

I don't know what else could be the problem. The 18+ section isn't actually 18+ - it doesn't allow pornography or anything, but tasteful nudity is allowed in the same way it's allowed on Youtube. I'm not sure if that's a problem.

Hi, although you don't have 'pornography' on your forum, I did saw quite a lot of content on there that could offend someone quite easily. It's best if you remove that and keep everything to a PG-13 rating. Nudity might be allowed on YouTube, but I don't think the same applies on Forumotion.

If you have nothing that breaches the Terms of Service by the 13th of June then the message will go away.

I am new to these forums and just recently took over primary duties overseeing the forum and would appreciate any help you could give. I received the same message, "Dear "ic4life.forumakers.com" forum administrator(s), it appears that your forum doesn't respect our Terms of service. Our service is free, so we are urged to only display legal content on the forums.

You have have until the 19-06-2011 to be in conformity. After this delay, we will have to delete your forum if it still isn't in conformity."

This is the first I've been made aware of anyone on the board breaching the terms of service but the message did not go into details as to what the offending threads or posts were. Please advise. Thanks.

It would most certainly be helpful to the moderators to notify them of specific offenses over a general message in the admin panel. Thanks again.

well some can argue that playboy magazine is tankful nudity which is in my opinion.
However it's still classified as a pornography and content for mature adults 18 and over..
Forumotion is free public forum hosting to those of the age 13 years and older.
It dose not matter if you have your sections marked as 18/adult and over. There is not such thing as private forums or sections on free forum hosting.

so tasteful or not, what one may see as being tasteful others my find offensive.I have told you before inm he last thread you had.That the best way to know whats within forumotions TOS with content such as this.it to make sure all content is appropriate for a 13 year old.If it's something that would not be appropriate for a 13 year old then it would be in y6our best interest not allow any such content.

Also make sure you are not allowing any illegal file sharing of things that may be under copyrights, such as music, movies videos etc...

Other then this it is the forums founder and staffs responsibility to maintain and moderate your forums,If you have a good staff and or other admins that maintian and moderate on a daily basis the best you can, it should not be hard to go through your forums content and know whats OK and what is not.

If you have a 18 and up section with nude pictures.. then i would just delete the whole section right off the bat and no longer allow it.
If it's adult content you want, then you may want to consider getting a paid forum that allows adult content, there are even free-hosting sites that will allow adult content as well, however i will not post any such link to those kinds of free hosting sites here on forumotion support.

I have never heard of youtube allowing nudity?
i know they do have an option to mark something as content for mature audience and you can also make videos private..But i think with youtube the reason a lot of that kind of content is on there is because it has not been reported/flagged yet.. if you flag something on youtube for any kind of pornographic or offensive materials they will remove it.

But at the end of the day it dont matter, forumotion are not responsible for contents that are on other sites/host.,They are only obligated to warn,remove or shut down any forumotion forum that is breaking Forumotions TOS and or international laws.

I've deleted the whole 18+ section now too.

I can't think of anything else that could be in breach of the ToS.

So now do I just wait to see if my forums get deleted in 3 days? Or will the message go away before then? Do I get another chance if there are things I missed or are they just permanently deleted?

This is the first time I've ever come accross an offence system where offences are not listed. If staff take the time to review my forum surely they can take an extra few seconds to mention what they found that is in breach of the ToS.

This is quite frustrating and if my forums get deleted that's several years work, 26,000 users, and over 300,000 posts gone because staff couldn't take a minute out of their time to tell me what the problem is specifically.

PS I know it's a long shot but if any staff read this I'm willing to pay $1,000 for my forum database.

yeah this is how forumotion litigations do things,
I am sure if they see what ever was reported removed and that you are making an effort then your forum will be fine.

As far as forumotions litigation's policies on how they investigate and conduct decisions.That is something only the forumotions litigation team know.
Keep in mind what ever the violations, forumotion felt it was not enough to shut shut your forum down without out any notice.. most of the time if they receive violation reports they will just shut the whole forum down right then and there or hand it over to onlinegurdian with no notice at all.

So yeah if i had an answer why litigations do not tell you what violations are taking place then i would tell you.The only thing i can think of is they have to many reports to investigate and do not have the time to give each individual forum information on what violations are taking place,so instead of killing the whole board/shutting down your forum they give you a chance, and it's up to the admin and staff to go through and remove any violations .

Thats all gone now.

Willl there be a problem with a section that allows real life item trading? In other words people making threads buying and selling real items for cash. I have such a section and as far as I know it's perfectly legal to facilitate a trading environment, but I don't know if it relates well to the ToS.

Probably not, but I'm not 100% sure. Make sure that the things being traded are not illegal nor can anything posted on the forum pose a security risk to individuals.

Nothing illegal is being traded. It's just things like xbox games and such. What could be a security risk? Would it be against ToS to post anyone's IP address? We post the IP's and some other info of people who scam others in our markets. I guess I could remove that too if you think it might be a problem.

For what it's worth, on my forum, I have done a clean sweep of all things I found that contained nudity/pornography, have taken measures to delete/censor all racial slurs, and have removed any further offending content. I have attempted to the best of my ability to comply with the rules and regulations set forth and would appreciate further notice if something on the content of the board is still out of compliance that I may have missed. Thanks.

If you have nothing that disrespects the TOS by the time the date on the warning arrives then your forum should be fine.

I'm another one of the mods on the ic4life forum and I don't find this very helpful. We're just supposed to remove what we think is against TOS and wait for the date to come and go and see if our forum survives? Can you not tell us which part of the TOS we're not respecting? That way we can know for sure we're in compliance and stop stressing about it. It would also allow us to make sure it doesn't happen again. Just sayin'...

I don't have access to the litigation reports so I can't tell you what has been breached. But, if you need to find exactly where you have gone wrong then I suggest to re-read the TOS again and look through your forum: http://www.forumotion.com/en/create-forum/terms-of-service.htm

So who has access to the litigation reports that could give us the information? I've read the TOS already and a lot of it is open to interpretation.
