Hello All!

Before I get the flames for "You posted this in the wrong spot dummy" I would have posted this in "General" but I am not able to due to Special reasoning (Maybe I am way too new?)
Anyways Reading over the terms of service for the third time or so, I wanted to outline a few things and question the legal aspect of data integration, and collection of data.

1: Data and security -- But for any reason, no individual backup or SQL dump, or database will be provided
2: Forums import -- All users having a PhpBB, Invision or PunBB forum with a self-hosted installation can import their forum on the forumotion.com service.
3: Responsibility of the login and the password: You have to make sure that you disconnect from your account at the end of each session. forumotion.com cannot, and will not be held responsible of any loss or damage which results from a breach in these conditions.
4: Use of your personal data When we do appeal to third parties in the processing of your personal information, we ensure that they respect our rules of confidentiality as well as any appropriate confidentiality and security measures.


1: Why are we not entitled to our own backups? If we are to be entitled for our forums per the comment here under: Responsibilities: The user of the site is held responsible of any damage of any kinds, materiwritl or immaterial, indirect, caused to any third-party, including forumotion.com, by the fact of the illicit use or exploitation of the site itself or one of its elements, whatever the cause and the location of the damages, and guarantees forumotion.com from the consequences of the complaints or legal action he might be faced to. We would then be entitled to our own data due to being liable to it. Thus we should have a full right to have a backup of such database at the request of the user.

2: You allow us to import third party SQL databases, but we are not allowed to export our own databases? What if we wanted to host our own forum on the same forum software but via a webhost due to lack of permissions? These may include wanting to write plugins or allowing full configuration of the template.

3: This one is pretty interesting. If we are forced to logout after using the website, why do we have the "Log in Automatically" checkbox implemented in the forum templates? Oh wait, this is used for "quick access" login. (But also still the users responsible)

4: You will need to define "Rules of confidentiality" as these are very broad terms and not explained no where in it. Unless you mean its collecting "cookies" which by that in nature also needs to explain what is collected. Since there isn't a privacy statement neither.

If you would prefer a direct message please feel free to let me know. Seeing as already the PHPBB license is GNU v2 already and since per the GNU license https://www.gnu.org/licenses/gpl-faq.en.html#GPLCommercially it does state must be public if you are to make money off it. I am more interested in 1 and 4 at most. Please PM me or reply your choice.

All support topics should posted in the support sections. This is considered a support topic.

1. The database is more than just the design of your forum. Also Forumotion does not use the official phpBB versions. They use a license that they have heavily modified.

Before you create your forum, you should read the Terms of Service.

4. This just lets you know that Forumotion tries to use third-parties that follow the same guidelines to privacy practices. This does not apply to individual founders, but third-parties.
I understand its not related to the "Forum Owner" but what is this "Rules of Confidentiality" You have to understand when it comes to personal privacy, I strive to protect that. So I would like to understand this concept. Again if you feel this should be a "PM" thing let me know.

On 3, I persume the login automatically box simply relogs you back in automatically when you re visit again. After a period of time the system considers you offline and logs you off, when you visit again, your browser automatically re logs you back in.

That would violate the terms then... Since the user is required to logout. Again I am more concerned in #1 and #4 because those are more broad terms on issues.

You do logoff, but you get auto re logged in again next visit by your browser. No where does it say you can't be auto logged in each visit, it just says that you will be logged off by our system at the end of each visit.

Wait a minute, I just read what you posted and I think you are mis interepting what it says. I think it means is that you should log out at the end of each visit to ensure that no one else accesses your account, it doesn't say you HAVE to, it says you SHOULD. You can choose to stay logged in, but that part of the tos is just saying that forumotion is not responisble if someone else accesses your account as result of your choice to stay logged in.

Once again, it is not saying you HAVE to log off, it says you SHOULD log off, it also basicly says if you choose to not log off after each visit then forumotion is not responsible if someone else accesses your account from that computer.

That is all that is saying.
