Litigation issue and Reporting of Abuse Empty Litigation issue and Reporting of Abuse

Post by malevolent heretic on February 10th 2010, 2:08 pm

Hello, I'm hoping I can get some guidance on a rather grey issue with the forums surrounding the report of abuse and the terms and conditions one accepts when creating a forum with forumotion.

I have in the past and other members of the public complained about the content of a forum on forumotion using the report abuse facility, however there is a problem with this service when the owner of the site who gets the complaints posts them on the forum as a form of entertainment for the members. So effectively this forum is running without official responsibility and in breach of the Forumotion rules. An example of this can be seen here :

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/companies-finacial-reports-who-s-getting-paid-neslings-mate-t7842-15.htm

For example, under "Illicit contents" section you clearly state "Forums that does welcome or promote warez, piracy, hacking, cracking, spamming, attacks against networks or servers, pornography, racial hatred, crimes against humanity, inappropriate activities on the servers, or any other actions which violate any applicable laws, aren't allowed. Any forum which contains texts, links, pictures, animations, videos or any other content recognized as illegal will be deleted without notice or warning."

The data contained on this thread is contravening this rule:

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/links-to-all-chapters-of-the-truth-of-the-lie-t7158.htm

Additionally, in your terms and conditions you stipulate that any forum containing hateful or abusive content, defamatory content and/or affecting the integrity of a person will be deleted without further notice.

I assume hateful and abusive comment like this:

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/companies-finacial-reports-who-s-getting-paid-neslings-mate-t7842.htm

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/barbara-nottage-carter-ruck-t7876.htm

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/winning-his-spurs-clarence-mitchell-shadowy-controller-of-the-fate-of-millions-t7838.htm

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/see-you-in-court-mr-and-mrs-mccann-by-jhl-t7397.htm

http://missingmadeleine.forumotion.net/hate-forums-mccann-helpers-f130/pro-mccanns-plotting-now-against-this-forumyawn-zzzzzzzzzzzzzz-t4070.htm?sid=f443f74741c8a7a2d1c3a296b5100f5e

http://missingmadeleine.forumotion.net/hate-forums-mccann-helpers-f130/?sid=f443f74741c8a7a2d1c3a296b5100f5e

Also in regards to defamatory content and/or the integrity of a person and copyright infringement I assume any thread in this topic falls into the category:

http://missingmadeleine.forumotion.net/other-forums-blogs-c12/

My question is, in the absence of a forum owner who does not respond to the litigation system in place, how is it possible to escalate such issues and violations so they can be reviewed and dealt with in a timely fashion ?

Is there a contact email address that can be used in such circumstances ?
The reason I ask is that this information would be useful to organisations like e-victims and the Internet Watch Foundation and in this particular case, the law firm that is handling the breach in the law of the illegal content posted on this forum.

Cheers in advance

By sending report Abuse, you are sending the forum administrators notification.

To report it to forumotion.

Thanks Sanket, but I'm afraid that doesn't work. The owner of the site ignores them and posts the litigations on to forum for entertainment purposes for the members, an example of this can be found here :

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/companies-finacial-reports-who-s-getting-paid-neslings-mate-t7842-15.htm

What would be helpful is a contact or a procedure that I and others can use that bypasses the owner of the site and goes straight to Forumotion so they can review the the content to establish whether the terms and conditions of Foumotion have been broken.

Are you able to help with this ?

Cheers

Sanket, thanks for this but there must be some confusion, I have just filled in the form at this site and verified that I want to send it upon where I am told the litigation has been passed to the owner of the Missing Madeleine Forum which is not what I am wanting to do because the owner of the site ignores the litigations and posts them up on the forum for entertainment purposes, an example being :

http://missingmadeleine.forumotion.net/main-maddie-thread-latest-news-f1/companies-finacial-reports-who-s-getting-paid-neslings-mate-t7842-15.htm

Can you please let me know a way of contacting Forumotion directly which by passes the owner of the site when the instance arises that the owner has no interest in acting upon the litigation. This information would also be good to have so organisations like e-victims and the IWF can use it or advise others who have been affected by the activities of this site.

Cheers

Ok thanks Sanket, I was just confused as it says on the page once you have verified the litigation that it has been sent to missingmadeleine.forumotion.net

All is clear now.

I note that the forum has now gone to log in only, so it cannot be read, hopefully the forum administrator is cleaning up the forum.

The litigation goes to both the forum admin and Forumotion.

Litigation issue and Reporting of Abuse Empty Re: Litigation issue and Reporting of Abuse

Post by Iamme on February 10th 2010, 8:30 pm

Am I totally missing something here in reading this thread Confused So Forumotion gets the information and a complaint sent about a forumotion forum, and probably by many, if that site is anything to go by. They then decide to send it on to the admin of a forumotion forum, but just what is being done by forumotion themselves in the meantime?

Do they respond by email to those who might have complained about the forum to let them know what actions they may be taking, and if not why not?

If the complaints are forwarded onto the site admin or admins, isn't that just a way of passing it on to save them having to deal with complaints themselves? Confused

Hang on, Why does forumotion send a complaint about the admin of a forum to that admin?

Thats a bit silly isnt it? What if the person complaining is a member of that forum? Surely that could make trouble for them?

Id like to the answer to the questuon above too, Do forumotion respond to these litigations?

The litigation goes to both the forum admin and Forumotion.

Only one of the above threads is login only, the rest are still open, I just checked. Sorry I did now! What a place

I'll clear this up.

If you send an abuse on the forum at the bottom on the forum its sent to the Admin of that site. If you use the link that Sanket gave you Forumotion will get it and review the report and if there is action that is needed they will tell the Admin to remove it or they will have their forum removed. They might just take action and delete the forum at first since its not following the ToS.

No, They are sent to Forumotion to be reviewed and then Forumotion decides on what to do.

MrMario, with submitting the litigation this afternoon, how long does it normally take to process and is there anyway further evidence of breaking the terms and conditions of forumotion can be introduced into that litigation ?

No problem, thanks for information MrMario. With regards to my other question, is it possible to introduce further evidence to my initial litigation logged with forumotion as further death threats have been made today?

Well if the admin dont get litigations, how come the admin there has posted this:-

9 Jan 2010

Label :
Copyright infringment

Description :
A clear copyright infringment of a photograph of Clarence Mitchell.
No prior permission was applied for to the photographer of the photograph.

It clearly states on the blog which this photograph was taken from, 'is not to be reproduced without prior permission. All Rights Reserved.' The author of the blog did obtain prior permission.

Also the remarks on the thread are derogatory and abusive towards Mr. Clarence Mitchell and need to be addressed.

This is a clear violation of Forumotion rules and I trust that swift action will be taken to remove the offending material. Should it not be, further action will be taken and the matter will be taken up with Carter-Ruck Solicitors.

Proof (screenshot)
Link

Status :
Open

It was a litigation sent direct to this forum....it was about this photo but there's lots of holes in it Smile

Thats just one of many shes posted up.

They obviously do go straight to the admin.

Thanks deanna I hadn't seen that one before.

Mr Mario, just to add to what I was asking before, could this thread be considered with the litigation as well. The litigation text field that I filled in this afternoon was an amended from an email that I sent to the London based law firm that is dealing with the illegal content and did not include all the links in here.

Your guidance in this matter would be most appreciated

Are forum owners permitted to do this ?

Abuses and litigations
Active abuses 0

The other 29 litigations were not taken seriously and removed....

Just a thought you know

Is it normal for a forum with so many complaints to be allowed to stay online?

Litigation issue and Reporting of Abuse Warnin11malevolent heretic, Please don't double post unless it’s been 24 hours from your last post.

If you want you can send more but I would contact Typlo instead. Because there are some many abuse is because its sent to the Admin of the Forum not to Forumotion so they don't know. The Litigations where closed as there wasn't anything found that could take the forum down. I am going to lock as I don't have anymore to add nor handle this besides pass stuff to Typlo. If you have any more questions about the Litigation I recommend you contact Typlo.
