If it is not on Hitskin then it is a customized theme that you need to ask the designers of it for permission to use it.

if you have hitskins on this will over write, and i did NOT add hit-skin markers to this, i may at a future time if people request for it, but i have no current ...

The easiest way, if you know the owners of the forum, or if you are the owner, you can Export a theme in the display section of your forum and import it into a new site. However, this will not copy things such as special templates that have been edited, or images for the forum. You will still need to add all these manually.

You do not have to download. You can just install directly from Hitskin.
