Some of them are created by the creators who created the themes which can also be copyrighted by the original creator so I advice you to ask/contact the creator of the theme where you want to get the images to avoid the deletion of your theme in case someone will report your theme/forum.

it was always my thought that is someone is creating a hitskin it then belongs to hitskin for anyone to use. But like Joph25 said if you came across anything with someone saying they own the rights to the images then i would contact them just to be safe.
