    Solved Terms of Service Compliance

Post by Serak Xavier September 11th 2012, 6:10 pm

I am an Administrator on the board "Bleach Gotei" under the Tova Diabló account.
Recently the ACP has been listed with a notification of pending post deletion if the board is not put within conformity within about nine days from this writing. We were not told what would be violating the TOS and we are, largely, clueless. Obviously we do not want our extremely large board deleted over something like this. I have re-reviewed the Terms of Service very carefully and cannot find out what has gone wrong.

The only hint is that our Founder, typically absent for 8 - 12 months at time, dropped by and silently deleted a seemingly arbitrary thread. This thread in no way came close to violating the Terms of Service (nothing pornographic let alone illegal; we're writers!) and I find it strange to think these would be related. Even with the deletion the notice remains. It was, however, a controversial fictional event within our story (which makes me wonder if a disgruntled player had anything to do with this). We are, obviously, a Bleach Roleplaying Game. One of the top ones here on Forumsmotion that you proudly list. One of the top ones in your general Manga-based RPG category even. So I highly doubt our long-standing nature as a Bleach-based game is the issue itself, correct me if I'm wrong. We're just here to write stories.

I would like to know just what part of the Terms of Service we violated and where so we may resolve this issue without fail.
I would like to know if it is at all possible to tell me what we need to do to rectify this situation. We will hurriedly and happily oblige.
I would like to know if we have the right to face our accuser (or at least see the litigation that resulted in this), as it is clear that someone or something had to report us.

I appreciate your consideration and time.

    Thanks in advance,
    Serak Xavier

You will need to read through the terms of service - https://www.forumotion.com/en/create-forum/terms-of-service.htm , then go through the whole forum to check for any violations. It is the responsibility of the forum staff to know what is on the forum.

    I appreciate the reply.

Which is exactly what we have done in the past ~40 hours. There was never any illegal or pornographic content to violate the Terms of Service. Just a Bleach game, like the many others you host. I actually found the Litigation in our ACP but minutes ago and have found, much to my dismay, that the claim of "graphic rape" and one of our administrators being a "child predator" are complete fabrications equivalent to slander (if not libel) from a member of ours who is rather remorseful of having wrongly sent that in our of anger. The link and screenshot provided depicted nothing of the sort, let alone anything illegal.

No rape ever occurred, fictionally or otherwise. No child abuse ever occurred, fictionally or otherwise. No children--as most of our fictional characters are many centuries old--or rape were ever actually involved, fictionally or otherwise.
So you can imagine my confusion.

I apologize if I seem harsh or cold in my tone here, I do not intend it. I just wish this to be clearly and concisely communicated.

Those reports you are seeing do not go to the Forumotion litigation team. Those only go to the administrator of the forum. Are you seeing these on the last tab of the administration panel? You will not see the litigation report. I mean you will not see what is in the report.

Yes. Miscellaneous tab, Support section, Litigations (not abuses, this is above that). However the status is listed as Open, there's no option to close it and the person who sent it says she cannot either, and it's all setup just like your standard TOS Litigation form (linked in the TOS itself). It also uses the topic that our Founder mysteriously swooped in and deleted as the source of the TOS violation.

Perhaps two identical litigations were sent, one to the Forumsmotion team and the other that ended up in the ACP? I'm not sure how your system works in this regard, and if the link that creates litigations through the TOS page isn't the one that gets to your team I have to wonder what is. It'd be extremely strange if these were not related. The possibility that they aren't only leaves us further confused.

So if this is not the case I'm not sure what more we can do without knowing what the claim was. We have not posted anything illegal or violated the TOS in any such manner. We're just another Bleach game.
Could an additional review be done to see if we're still in TOS violation by whatever party did the initial report?

    Alright.

So all we can do now is just wait for the timer and hope we're still around when it goes off? If that's the case I understand, it's just incredibly nerve-wracking.
