    Basically what I want is to get the avatar from the user menu with a jQuery and don't display the toolbar, can I activate and then hide it (all of it) without breaking use agreements?

    Why do you have to have the toolbar activated if you only what to get the avatar of a member?

    You can not hide it if you have it activated.

    I want the avatar to be located in my custom navbar, and it's easier to get from there, the jQuery gets the image url from there and then puts it in another location.

    So, it's against the rules to hide the entire toolbar?

    When you hide it, you are hiding the copyright link (Forumotion) which is against the Terms of Services.
