    I just need some clarification on this.

    We have a user who has threatened us with legal action because they were banned for breaking our TOS repeatedly. They want us to delete their account, but in your article it states that we have the right to keep the account on our forum legally for up to one year so that justice could be served in legal matters.

    Would that align with this? It's the only way we'll be able to identify the user when legal proceedings are carried out.

    Yes, you can keep it up to a year if there are legal proceedings.  Question:  Is the member threatening legal action for the ban or deleting the account?

    Not sure which one. She emailed me after she was banned and threatened legal action, claiming she'd back off if her account was removed within 2 days. (I don't understand the time line.)

    I think she's embarrassed and doesn't want users to see her account is banned for repeatedly breaking both Forumotion TOS and our own TOS.

    She was warned several times for posting images that go against the nudity claus in Forumotion's TOS, which we've had to heavily enforce more recently as some users were still crossing the line. It's common practice for us to warn users twice before giving them a ban, since breaking Forumotion TOS can cause the forum itself to get in trouble.

    I would keep the evidence for a year, but have it in a section where the public can not see it.  The reason why is because someone could report your forum for the violations.  Even if the public can not see them, Forumotion can still see hidden areas of your forum.

    Yes, we moved all evidence to a private section so that only staff and forumotion could see it and we're saving all the emails from this point forward. Thanks for your help!
