i have automatically in my forum when a member has over 5 posts to gets from newbie to member group
my problem is that when a new member is spamming i delete lets say 4 posts so it shows in his profil that has
1 post ( = newbie) but his is still in the members group ..
so if a delete some posts doesn't this count to groups also? and make him reduce to a lower group

It's user-decided. You have to manually change what group they're in.

can i recover the deleted posts?

The posts from the spammer? No. Once you delete it, you can't get it back. However you can move it to another forum where you just keep them for future reference, say an archives forum.

If you restore the forum you can but you will end up losing post or members if you do if others posted and registered after the recent back up.
