Rapidshare and youtube links

Hello.

Let's say I want to create a forum where songs would be rated and ranked.
So, the problem is if people haven't heard the songs.

Question no1:
Placing links to rapidshare mp3 download on my forum and advising members to remove the files after 24 hours - is it legal?

Question no2:
Providing links on forum to youtube videos, which probably aren't legal as well (but 85% of youtube is illegal then, anyways) - is that legal, just placing youtube links on my forum?

For your first question, it's illegal to post download links for songs. You are legally responsible of all the content of your board, and there is no disclaimer which will protect you against the deletion of your forum if you put download links. You have to pay royalties and get the permissions from the authors before distributing songs, films, TV shows, etc.

For your second question, putting just the link leading to the youtube video is tolerated for the reason that there is no way to download these videos
