Banned as admin, help please.

First topic message reminder :

Recently, I joined a forum and recieved an administrator spot for merging my forum with said forum. I completely deleted everything and redirected my forum there. Apparently, now I am banned from that forum, which is a violation of their agreeement and somewhat of an abuse that I would like Forumotion to take seriously. I feel like I was tricked into this and nopw every single one of my users have gone over there- without my users, their forum would be dead by now. I brought their forum into life and I am taking this a bit personally.

Having said what I have, I would like Forumotion to tell me if I can do anything or if Forumotion will/can do anything. Their forum is http://clubpenguin.bforum.biz .

if they are using any part of your creation rather it be on your site or not as long as you can prove that you are the author of the material you can report

Well now they're apparently bashing me on the forum.

One of the moderators who was and is my friend on ther was recently (as in today) de-modded, and our suspicion is because he is affiliated with me. This is really becoming more of a "bash Hellopayton" problem now (that's my name on there). They unbanned two users who mocked me and spammed the forums and we would like this to stop.

Edit (2): One of my former users (well, all of them) has betrayed my forum and resorted to coming back on my deleted forum, messaging me and flaming. Here is a pic:

My friend who was a moderator there was de-modded just for being my friend and they unbanned the users I banned who were sending hate mail to me, mocking me and making it clear that they weren't going to obey the rules.

It is NOT a violation of the terms of service. He deleted his own forum.

You cannot copyright an "idea". Are you suggesting you are the only person ever to come up with a forum or website based on your main topic?

Alright - let's get some things straight here because there is a lot of completely false information in the thread.

Yes - the OP was tricked, but that is not a violation of the TOS by the other board. Unfortunate, but it happened. There is nothing FM can do about it. He deleted his forum from the CP so it is gone. Nothing can be done about that either.

You CANNOT copyright an "idea" or "theme" for a forum or website. Ideas do not fall under the "Intellectual Property" rule. You would have to substantiate that you were absolutely the first person EVER to come up with an idea - which is impossible. Just forget that nonsense.

By rule - the owner of a forum or website can do anything he/she wants to do as far as members are concerned. You have no legal rights or standing - an owner can ban anyone he/she wants, for any reason, and there is nothing you or FM can do about it.

The ONLY thing someone can do is if the other forum is using images you created - created - not obtained somewhere else. In that case you could have a possibility of copyright infringement IF you can PROVE you created the images. Saying you did is not legally sufficient, you have to PROVE it. FM cannot accept as proof that your forum existed before the other, so any images were created by you. That is legally insufficient.

This is an unfortunate situation, but that's all it is. Maybe someone will learn something from it and not let it happen again, but I doubt it, judging by some of the comments in this thread.

Kingdom is free to create another forum and rebuild what he/she lost. Maybe some of the people he lost to the other forum will come back - maybe they won't. He will get new members if the new forum is better than the other in content. That's life.
